City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />D) The portions of deck proposed to be constructed in <br />the 0-75' setback zone comprise 98 square feet on 2.2% <br />hardcover. Applicant has no additional existing hard- <br />cover in the 0-75' or 75'-250' setback zone which can <br />be feasibly removed to offset this 98 square feet. <br />E) Hardships to the property are the locations of the <br />existing house and the neighboring houses in relation <br />to the lakeshore, and the small existing lot size <br />(11,800 square feet.). <br />F) The adjacent property owners have expressed <br />approval of the proposed plans, an' find that no views <br />will be encroached upon by this addition. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Cc)-nmission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, •-he Orono City Council <br />hereby grants a variance to the Municipal Zoning Code Section <br />10.22, Subdivision 1 to permit the construction of an addition to <br />his existing house, which addition will. encroach 8 feet into the <br />required average setback area, and variances to Section 10.55, <br />Subdivision 8 and Section 10.22, Fubdivision 2 to permit con- <br />stuction of a deck and stairway which will encroach 8 feet into <br />the 75' lakeshore setback zone and which will increase hardcover <br />n the 0-75' setback zone from 0% (0 square feet) to 2.2% (98 <br />square feet), subject to the following conditions: <br />Page 2 of 4 <br />
