City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING A CONDITIONAL USE. PERMIT <br />PER MUNICIPAL ZONING CODE SECTION 10.03, <br />SUBDIVISIONS 19 i 20 - PILE NO. 931 <br />WHEREAS, J. F. Fleischhacker (hereinafter "the applicant") <br />is the owner of the property located at 2775 Shadywood Road located <br />within the City of Orono (hereinafter "the City") and legally <br />described as Tracts E, F & C RLS 358 (hereinafter "property"), and <br />WHEREAS, the applicant has applied to the City for a <br />Conditional Use Permit to permit the removal of 35 cubic yards of fill <br />along a 70 foot section of shoreline and the installation of a sand <br />blanket per Municipal Zoning Code Section 10.03, Subdivisions 19 and <br />20. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />Findings <br />1. The application was reviewed as Zoning File No. 931. <br />2. Th• property is located in the LR-lb Lakeshore Residential <br />Zoning District. <br />3. On June 17, 1985, the Orono Planning Commission reviewed the <br />application as proposed and recommended approval, based on <br />the following findings: <br />A) The 70 feet of shoreline is not high enough for rip rap to <br />be effective. <br />B) The installation of the sand blanket will prevent further <br />erosion of black dirt into the lake. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by staff and comments of the applicant and the effect <br />of the proposed use on the health, safety and welfare of the <br />community. <br />Page 1 of 3 <br />
