LINDY & JOHN PURDY
1975 FAGERNESS POINT ROAD
WAYZATA, MN. 55391
(612) 471-9712
_--
To: Mayor Mary C. Butler and Mem'_ers of the Orono City Council
Re: City Hardcover DO nitions
I
.UI 19 I
I
CITY OF ORONO
We have been askec' bs the City Zoning Admin:strator to write this note concerning the definition 04
what co''titutes hardcover for the purpose of issuing b%jildirQ permits. We feel strongly that the cu•ren.,
definii is, in mares, respects, inconsistent with the presumec intent of the ordinance. We are distressf
that the vaquenp, s r ! the current definition of hardcovi r has :aused a major inconvenience for u=_ and will add
significantly "-,i cost of securing a building permit. Qe w,,uld sincerely hope that the Council will taHe
this opportun, cy to examine and clarify the present deter itian of nardcover so that it can be applied fairly
and uniformly to other re=_iderts of our area who are seekira to improve their homes.
We believe that the purpose of the hardcover restrictior s is, a nouid continue to be, to: (1)
prevent excessive run-off into the Lake and thereby protect t( e quji:ty of this recreational resource; and ('2)
to control overbuiloinQ :r1 the City and protect its aesthetic Qualities. To accompi.sh the first part of this
purpose, the operative definition of hardcover should tie
Any artificial surface that causes rainwater to
run-o4f that surface into •.he Lake, or tributaries
of the Lake, rather than to be at'scrted :nto the
s--oil and filtered or to be retained and evaporated.
If you accept this defin:tio- of hardcover, then there are certain '.andscap, a features which s~ouid
n o t c o a s t t u t e hardcover:
o c, d, porous wood decking which has ar, atsorbant,
porous natural su4ace beneath it, i.e. no plastic
sheathing.
o Landscapinq rocks with either no plastic teneath or
with clastic that forms a basin in which the rain -
wale, is captured and e aporated.
Stairs and -etas, -:g wall steep slopes ( Greater
than a " ee inc:'ne dir....1y tc. Oie Lake ) that
do not F the amount of run-ofi which would
normally reach the lake.
'Ale also feel that the drainage patterns of a lot should be taken into corsideration in determinirrg the
amount of eligible square 400tage Con which t'.: hardcover lirrrits are defined. For example, if the "ridge
line" or highest points of a let are within the 75-400t li,,e, zligible square footage should be calculated from
