TO: Marc Whitehead, Village Attorney <br />FROM: Mike Scheller, Village Inspector <br />DATE: June 2, 1970 <br />SUBJECT: Erling Falk <br />As far as the best record w have on Lot 4 and any claimediaccretions <br />thereto, all the accretions belong to Orono. The Auditor's office <br />has no record to prove differently. <br />Regarding Item 6--the two dwellings mentioned are on Lot 4 and not <br />the accretions. There is no proof they occupied the accretions at <br />all since there are no buildings thereon. <br />Regarding Item 7--we have many lake accesses we do not publicly <br />proclaim to be ours, which are nevertheless ours. <br />Regarding Item 8--again, we do not have to "claim" what is ours until <br />somebody decided- it is not ours. <br />Regarding Item 4--I checked the conservation department to see if <br />this area was filled by awner as they say. Fill permits have been <br />required since 1937; however, I would have to see the abstract to <br />know who the owners were, as the permits are filed by name. I would <br />also think that records pro.'_uced in evidence from 1886 on would <br />show substantially the same shoreline contour even if water levels <br />were different. <br />
