j p.1 -fi ,14 v CITY of ORONO <br /> lios lir RESOLUTION OF THE CITY COUNCIL <br /> // <br /> \�9iCES1=1_04 NO. i VI k <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.24, SUBDIVISION 5 (B) AND <br /> SECTION 10.03, SUBDIVISION 9, <br /> FILE NO. 01-2719 <br /> WHEREAS,David F.Dalvey and Jodi A.Dalvey, (hereinafter"the applicants")are <br /> the owners of the property located at 1520 Bohn's Point Road within the City of Orono(hereinafter <br /> "the City") and legally described as follows: <br /> See Exhibit A <br /> WHEREAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.24, Subdivision 5 (B) to permit new residential construction on a lot that <br /> is 102 feet wide where 140 feet is required and Section 10.03, Subdivision 9 to permit an accessory <br /> structure on a lot without a principal structure; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on October 15, 2001, at which time all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #01-2719. <br /> 2. The property is located in the LR-1B Zoning District, where 43,560 s.f. or 1 acre is <br /> the minimum required lot area. The property consists of approximately 36,753 s.f. <br /> or .84 acres. <br /> 3.
