'��-� <br /> � O� <br /> • O O <br /> ��6. - CITY of ORONO <br /> � � � <br /> ��i �'�' RESOLUTION OF TH CI Y COUNCIL <br /> �9kESH�4� NO. 4� � °� <br /> � <br /> the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> � CONCLUSIONS, ORDER,AND CONDITIONS � <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to Municipal Zoning Code Section 10.24, Subdivisi�n 5 (B) to permit the construction <br /> of a new residence on a vacant lot,the new residence to be located 30' from the front lot line where <br /> a 50' street or front setback is normally required, and requesting a rear side setback of 29.5' where <br /> 50' is normally required, and requesting a south side street setback of 45.5' where 50' is normally <br /> required, and requesting a lot area variance for construction of a new residence on a property of <br /> 22,582 s.f. in area where lot area of 87,120 s.f. is normally required, and requesting a variance for <br /> the existing lot width which is 176' where the lot width is normally required to be 200'. Approval <br /> is subject to the following conditions: <br /> • 1. Council approval is based on the site plan submitted by the applicants attached to this <br /> resolution as Exhibit A. Any amendments to the site plan may require further <br /> Planning Commission and City Council review. � <br /> 2. Applicant is advised that because the proposed residence uses the entire 15% <br /> structural lot coverage allowance, additional structure on the property will not been <br /> seen favorably. <br /> 3. Authorities granted by this variance run with the property not with the applicants, <br /> but are permissive only and must be exercised by application for a building permit <br /> within one year of the date of Council approval, or this variance will expire on that <br /> date (October 22, 2002). � <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> . variance shall constitute a violation of the zoning code,shall automatically terminate <br /> any authority granted herein, and shall be punishable as a misdemeanor. <br /> 5. The undersigned applicants have read,understood and hereby agree to the terms of <br /> this resolution and on behalf of themselves, their heirs, successors and assigns, <br /> hereby agrees to the recording of this resolution in the Chain of Title of the property. <br /> • Page 3 of 6 <br />
