CITY of ORONO <br /> 0 b, RESOLUTION OF THE CITY COUNCIL <br /> �kESH j <br /> NO. 47 ® 1 <br /> A RESOLUTION VACATING A PORTION OF <br /> AN UNIMPROVED STREET WITHIN THE <br /> PLAT OF BAYSIDE ADDITION TO LAKE MINNETONKA, <br /> HENNEPIN COUNTY, MINNESOTA <br /> FILE NO. 01-2707 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, on September 22, 2001 Robert A. Eddington and Mark R. Larson <br /> (hereinafter "the applicants") filed a petition with the City of Orono requesting the vacation of <br /> a portion of an unimproved public right-of-way originally dedicated in the plat of Bayside <br /> Addition to Lake Minnetonka, Hennepin County, Minnesota lying between Lot 8 Block 2 and <br /> Lot 1 Block 5 thereof, and legally described as follows: <br /> That part of Hill Street which lies between the northerly extensions of the east <br /> and west lines of Lot 1, Block 5, "Bayside Addition to Lake Minnetonka", <br /> Hennepin County, Minnesota; and <br /> WHEREAS, after due published and posted notice, a public hearing was held <br /> by the City's Planning Commission on October 15, 2001 regarding said vacation and all <br /> interested persons were given an opportunity to be heard; and <br /> WHEREAS, after due standing and consideration, the Planning Commission <br /> recommended unanimous approval of the proposed vacation; and <br /> WHEREAS, the City Council of the City of Orono finds that said vacation as <br /> proposed is in keeping with the public interest and in consideration of the following findings; <br /> 1. The unimproved right-of-way contains no municipal sewer or other utilities. <br /> 2. The 40 foot right-of-way has never been developed as a public street. <br /> 3.
