0 <br />Resolution No. 994 <br />Page 8 <br />The City Council specifically notes the following areas of <br />non-compliance: <br />1. The continuing use of docks extending beyond the <br />permitted Dock Use Area including docks extending into required <br />side yard setback areas and docks extending more than 200 feet <br />waterward (see Exhibit A). The applicant has shown no intention <br />to eliminate non-compliance. <br />2. The continued use of private dockage on Crystal <br />Bay for commercial purposes. <br />3. The continued lack of plans for required front yard <br />landscaping and replacement of natural vegetation. <br />4. The continued lack of compliance with required side <br />yard setbacks including the encroachment of boat storage on the <br />neighboring residential properties. <br />• The City Council further requests that North Star Marina, <br />Inc., submit a revised 1979 Commercial Dock License Application <br />addressing the specific items of non-compliance noted above. Said <br />revised application will be reconsidered by the City Council, <br />without the normal requirement for a new application fee, if North <br />Star Marina, Inc., shows a good faith effort toward compliance with <br />the regulations of the City, the LMCD, and the DNR. North Star <br />Marina, Inc. should be prepared to resubmit the 1979 application <br />before March 1, 1979 in order to ensure prompt review by the City. <br />Adopted by the City Council of the City of Orono at their meeting on <br />the 13 day of February 31 19 79 1 <br />ATTEST: <br />Walter R. 4enson, Clerk/Administrator <br />
