C <br />• RESOLUTION NO. 984 <br />i A RESOLUTION APPROVING THE PRELIMINARY PLAT <br />OF P. GERALD MILLS, 1600 SHORELINE DRIVE <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development <br />of land within the City; and <br />WHEREAS, the Planning Commission and City Council have <br />considered the application for a subdivision plat for P. Gerald Mills, <br />NOW,.THEREFORE, BE IT RESOLVED, that based upon all of the <br />information presented by the applicant and reports by the City staff, <br />consultants and the Planning Commission, the City Council of the <br />City of Orono hereby approves the preliminary plat for P. Gerald Mills <br />with the following conditions: <br />1. Five lot division according to survey by Gordon Coffin, <br />dated July 12, 1978 (revised as received by City on <br />December 29, 1978). <br />2. Lots 3, 4, 5 will be riparian to Lake Minnetonka <br />(Tanager Lake) by means of direct shoreline access. <br />3. Lots 1, 2 will be riparian to Lake Minnetonka (Smiths Bay) <br />by means of ownership of lakeshore outlots.' Outlot B shown on <br />the December 29, 1978 drawing shall be divided to provide <br />a separate outlot for lots 1 and 2 and said outlots shall be <br />legally combined for tax purposes with respective lots 1 & 2. <br />4. Access shall be by means of a private road platted, as <br />Outlot A. The existing road may be used except for a new <br />entrance to'be 22 ft. wide located where shown. The new <br />entry shall be constructed prior to final plat approval or <br />a developer's agreement shall be entered into to provide <br />,for such construction. Upon completion of the new entry, <br />the existing entry shall be removed. <br />A Road and Utilities.Easement shall be granted to the City <br />,over Outlot A. The Council specifically notes that the <br />existing 15 ft. wide roadway is a minimal width which would <br />�• not be permitted except for the extenuating existing <br />circumstances in this particular'situation. <br />
