UTILITIES EASEMENT <br />THIS INDENTURE, made this 29th day of December, 1978, by and between <br />Phillip and Lynn M. Rusciano, husband and wife, hereinafter referred to as <br />"Grantor(s), and the City of Orono, a municipal corporation, under the laws <br />of the State of Minnesota, hereinafter referred to as "Grantee". <br />• WITNESSETH, that Grantor(s), in consideration of the aum of One -.Dollar <br />($1.00) and for other good and valuable consideration given by Grantee,. the <br />receipt of which is acknowledged by Grantor(s), do(es) hereby grant, bargain, <br />sell and convey to Grantee, its successors and assigns, an easement for public <br />utilities purposes and uses, on, across and under the land in the County of <br />Hennepin and State of Minnesota as follows: <br />A 20 foot permanent esse6ent for sanitary sewer purposes over, under and <br />across that part of the Southwest Quarter of Section 34, Township 118 North, <br />Range 23 West, Hennepin County, Minnesota described as commencing at the point <br />in the south line of said Southwest Quarter distant 214.00 feet east from the <br />southwest corner thereof; thence no;th 813.55 feet; thence east 19.47 rods; <br />thence south parallel with the west line of said Southwest Quarter to the <br />south line thereof; thence west to the point of beginning. The center line <br />of said easement is described as follows: <br />Commencing at the southwest corner of the Southwest Quarter of said <br />Section 34; thence North, assumed bearing, along the west line of said <br />Southwest Quarter, a distance of 774.32 feet; thence North 89 degrees 46 <br />minutes 15 seconds East 214.00 feet to the point of beginning of the center <br />line to be described; thence continuing North 89 degrees 46 minutes 15 <br />seconds East 308.39 fast= thence South 02 degrees 22 minutes 13 seconds East <br />216.14 feet; thence South 43 degrees 04 minutes 25 seconds East 25.00 feet <br />and said center line there terminating. <br />-Said permanent easement contains 10,105 square feet more or less. <br />including, but not by way of limitation, a full and free right and authority <br />to enter upon said land to construct, instal, maintain, operate and repair <br />a sanitary sewer lift station, sanitary sewer interceptor, sanitary sewer <br />main or line, and any and all appurtenances incidental and relatedthereto, <br />(such are hereafter collectively referred to as the Improvement), and the <br />Grantee shall have the right to make such use of said land as in reasonably <br />necessary and advisable to the construction, installation, maintenance, op- <br />eration and repair of the Improvement. <br />• In addition to any other remedy the Grantee may have, the covenants and <br />restrictions contained herein may be enforced by injunction. <br />} _ ....•, <br />0 <br />
