No access or curb cut shall be permitted onto Orono <br />Orchard Road except for the new Private Road (for Lots 1-9, <br />11 & 12) and the new Private Driveway (for Lots 9, 10 & 13). <br />3. Installation of septic systems on most lots may require <br />additional testing and/or installation of innovative designs <br />such as mound systems, which testing and/or design will be <br />required before issuance of any building permit. This <br />condition is required for compliance with Ordinance 210 <br />because the subdivider has not provided complete soil boring <br />information for determination of water table depth and <br />because the areas previously tested for percolation on certain <br />lots have been disturbed during site grading operations. <br />4. Because of overall lot density, Lots 2 & 3, Block 1, <br />are approved as building sites even though being less <br />than 2.0 acres of dry land with the stipulation that all <br />setback distances shall be met and no setback variances <br />will be permitted. <br />5. The aforesaid plat shall be filed with the Hennepin <br />• <br />County Recorder's office on or before May 14, 1979 together <br />with a certified original copy of this Resolution and <br />executed copies of Exhibits A, B, & C as noted above. <br />The approval granted by this Resolution shall expire if the plat has <br />not been filed by the date specified above. In that event, it will <br />be necessary to file a new application with the City of Orono for <br />subdivision review. <br />Dated this fourteenth day of November 19 7 <br />William B.
