as hereinafter provided. Any assessments authorized herein, together <br />• <br />with interest, costs <br />and reasonable attorneys' <br />fees, shall <br />be a <br />continuing lien from <br />the -date payable against <br />the Owner's <br />fee <br />interest in the Lot assessed. Each assessment, together with interest, <br />costs and reasonable attorneys' fees, shall also be the personal <br />obligation of the person who was the Owner of such Lot on the date <br />said assessment became due and payable. Such personal obligation of <br />an Owner shall not pass to his successors in title or interest unless <br />expressly assumed by them or unless prior to such transfer, a notice <br />of lien for such assessments shall have been filed in writing with <br />the appropriate office of real estate records for Hennepin County, <br />Minnesota. No Owner shall escape liabilitv for the assessments <br />which fell due while he was the Owner by reason of non-use of the <br />Common Roadway or Common Driveway or non-use, transfer or abandon- <br />ment of his Lot. <br />B. Purpose of Assessments. The assessments levied by <br />the Association shall be used exclusively to promote the health, <br />safety and welfare of the Owners and residents of the Property, <br />and to construct, manage, improve, maintain, repair and administer <br />the Common Roadway, Common Driveway and all improvements, roads, <br />landscaping, and pipes, wires or other conduits of matter or <br />energy located upon either, or upon the Ut'il'ity and Drainage Ease- <br />ments and to maintain the Drainage Easements. <br />C. Annual Assessments. The Board of Directors shall <br />fix the annual assessment each year in accordance with the pro- <br />visions set forth in the By -Laws of the Association. <br />D. Special Assessments. In addition to the annual <br />assessments authorized above, the Association may levy, in any <br />assessment year, a special assessment for the purpose of defraying,, <br />in whole or in part, the cost of any construction, reconstruction, <br />repair or replacement of a capital improvement upon the Common <br />Roadway or Common Driveway, including fixtures and personal <br />property related thereto, provided that any such assessment shall <br />have the assent of the Owners of all of the Lots abutting the <br />-7- <br />
