Applicant submitting an accurate survey of the subject property <br />designating setbacks of all structures. <br />2. Staff determination of variances* required: <br />a) which structures are in violation <br />b) degree of variance to be requested by applicant <br />c) review number of animals housed in pole barn <br />*Planning Commission held that structureaviolating setback requirements <br />could be recognized as legal non -conforming uses but accessory structures <br />in residential zones are permitted uses. The desired limitations for <br />violating structures can be imposed at the time the owner requests a <br />building permit for either improvement or fire damage. <br />STAFF UPDATE - FEBRUARY 2, 1979 (Alan P. Olson) <br />In answer to Planning Commission question 2 above, the 6 calves <br />currently housed in the barn are permitted in this zoning district. <br />Staff recommends approval based on Planning Commission findings as <br />follows: <br />1. Preliminary plat approval as proposed. <br />?. Technical setback variances for existing structures, <br />including barn and chicken coop. <br />3. Final plat to include: <br />a) Dedication of right of way for County Road 84 at <br />existing width of 33 ft. <br />b) Dedication of drainage and utility easements along <br />lot lines. <br />c) Dedication of drainage easement over wetlands area on <br />center -east side of lot with flowage and conservation <br />easement to the City. <br />4. Nc park dedication fee (2 existing houses). <br />
