MINUTES OF THE ORONO COUNCII. MI•:ETING HI:I,h APRIL 22, 1985, AT THE ORONO MIDDLE <br />SCHOOL AUDITORIUM AT 685 OLD CRYSTAL BAY ROAD - PAGE 10 <br />PUBLIC HEARING <br />(CONT.) City Attorney Rad; stated that there are a number of cases <br />where the court determines that there was not enough evidence <br />presented by the City in a appeals proceeding showing any <br />increase in the valuation of the property, and have <br />eliminated portions of the assessed cost. <br />Judy Kyker of 3585 Sixth Avenue North asked the Orono Council <br />to try what the City of Minneapolis has done in the past where <br />the assessments, for those who are in need and cannot pay the <br />assessments, that those assessments are held in abeyance <br />until that property is sold or owner dies and then the <br />assessment is paid. <br />Mayer Butler explained that there is a deferred assessment <br />program availaoie for those over 65 years of age who meet <br />certain income criteria. Butler explained that the <br />assessment would be set aside initially for five years and <br />the City has the option of setting it aside again after 5 <br />years, and the only time that assessment becomes due and <br />payable is through the estate of a deceased individual or if <br />their financial status chang%s. <br />Bob Albertson of 2100 Sha :,,4 -d Road stated that when the <br />sewer project went through _ir neighborhood, many people <br />had to sell their homes because of the assessments. <br />Albertson was afraid the Council would set a precedent if <br />th•-y were to divide the assessments in the Crystal Bay area <br />because the next area to be sewered is the Stubbs Bay area. <br />Albertson stated if the Council pusses this sewer project and <br />divides the assessments, the rumor is going to be out that <br />Orono will divide future sewer project assessments over the <br />general trx rolls. <br />Judy Christensen of 1251 Brown Road South explainer: that in <br />the Minnetonka Bluffs sewer project the individual <br />homeowners were assessed $9,833 and 22 homeowner- appealed <br />their assessment on the basis that their proper+ .-s did <br />not exceed that amount. Christensen stat-,�d }hei. <br />assessments were reduced to $6,000 which 1(,.. _d the <br />individual benefitting property owners share but that <br />someone else had to pay for that extra. <br />Jeff Carson stated that h? is representing the Wayne's at <br />1950 Shoreline Drive. Carson noted that they have not <br />submitted a formal objection yet because they don't know what <br />they would be objecting to. Carson asked the Co..nci 1 what is <br />defined as a unit and also how many units 1950 Shoreline Drive <br />would be assessed and at what cost per unit. <br />Mayor Butler stated that 195U Shoreline Drive has four <br />dwelling units. Butler defined a sewer unit as one sewer <br />unit per dwelling unit, therefore_ four units would be <br />assessed against 1950 Shoreline Drivt Butler stated that <br />his object iron would be the 100 percent assessment against the <br />prrjE vrt y . <br />
