RESOLUTION OF THE CITY COUNCIL <br />NO. 1600 <br />2. Foundation and roof drainage must be directed away f-om Ivy <br />Lane. <br />3. Owner placed on notice that portion of retaining wail that <br />remains in Ivy Lane right of way may have to be removed in the <br />future at the request of the City and at owner's expense. <br />4. Soil erosion controls (hay bales) must be installed prior to <br />construction along lakeside edge of the areas to be regraded. <br />5. No runoff may be diverted over property lines. <br />6. Required soptic repairs must be •--om pleted this spring <br />subject to approval of the on -site septic system rianager. <br />7. No other variances are granted nor permitted for this <br />Application. <br />R. The undersigned shalt indemnify and hold har:nl�-ss the City, <br />the City Council, and the agents and employees of. the C--�-y from and <br />against all claims-, damages, losses or L-xpenses, including <br />attorney fees, which the City, City Council and agents and <br />employees of the City may suffer or for which it may be held <br />liable, arising out of or resulting from the assertion against <br />them of any claims, debts or obligations in consegoence of his <br />performance of the following improvements: <br />Construction of retaining wall% encraoching ,upon or located <br />within the right of way of Ivy Lane. <br />9. Violation of or noncompliance with any of the terms and <br />conditions of this resolution shall constitute a violation of the <br />Zoning Code, shall Automatically terminate any, aothoritygranted <br />herein, and 'shall be punishable as a mis<ior, ..:anor. <br />141. The undersigned have read, unders:.00d and hereby agrees to <br />the termsof this resolution and hereby . grees to the recording of <br />this resolution in the chain of title of the property. <br />
