City of ORONO RESOLUTION OF THE CITY COUNCIL N( 1675 c) The proposed level of use will be compatible with the surroundng two -acre res.idential zone. d ) The proposed use presents no more an intense use of the property than a hobby farm use. e) The City received no negative comments from the surrounding property owners notified during the review. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the owner and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that t-e conditions existing on this property are peculiar it and do not apply generally to other property _ this zoning district: that granting the variance would not adversely affect traffic conditions, light air nor pose a fire hazard or other hazard or other danger to neighboring property; would not merely serve as a convenience to the owner, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the owner; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. Conclusions, Order ind Conditions Based upon the above findings, the Orono City Counci 1 i.- grants a variance to Municipal Zoning Code Section 10.20, Subd 3 0 permit the keeping of horses for the purpose of breeding, training ana sale to the publi subject to the following conditions: 1. No other variances are granted or permitted with this application except the one specified above. 2. Authorities granted by this variance run wi;, the property not with the owner, but are perm' ssive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date September 10, 1985.
