City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />N( 1675 <br />c) The proposed level of use will be compatible with <br />the surroundng two -acre res.idential zone. <br />d ) The proposed use presents no more an intense use of <br />the property than a hobby farm use. <br />e) The City received no negative comments from the <br />surrounding property owners notified during the <br />review. <br />4. The City Council has considered this application <br />including the findings and recommendations of the <br />Planning Commission, reports by City staff, comments by <br />the owner and the effect of the proposed variance on the <br />health, safety and welfare of the community. <br />5. The City Council finds that t-e conditions existing on <br />this property are peculiar it and do not apply <br />generally to other property _ this zoning district: <br />that granting the variance would not adversely affect <br />traffic conditions, light air nor pose a fire hazard or <br />other hazard or other danger to neighboring property; <br />would not merely serve as a convenience to the owner, <br />but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial <br />property right of the owner; and would be in keeping <br />with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />Conclusions, Order ind Conditions <br />Based upon the above findings, the Orono City Counci 1 i.- <br />grants a variance to Municipal Zoning Code Section 10.20, Subd 3 0 <br />permit the keeping of horses for the purpose of breeding, training ana <br />sale to the publi subject to the following conditions: <br />1. No other variances are granted or permitted with this <br />application except the one specified above. <br />2. Authorities granted by this variance run wi;, the <br />property not with the owner, but are perm' ssive only and <br />must be exercised by application for a building permit <br />within one year of the date of Council approval, or this <br />variance will expire on that date September 10, 1985. <br />
