<br />THIS INDENTURE, made and entered into this 3rd da. cf

<br />E1is P. I,ronby and Thomas M. Crosby
<br />heirs. ,aass�yns, successors (hereinafter collectively
<br />referred to as the Grantor (s) ) and the City of Orono, its suc-
<br />cessors and -signs, a municipal corporation under the laws of the
<br />State of Minnesota (hereinafter referred to as the Crantee).
<br />IIITdIF.S:;ETII, Grantor (s), for and in consideration of the sum
<br />of One Dollar (�1.00) and other valuable consideration, hereby covenant,
<br />grant, gift, quit claim and convey to Grantee the right to restrict
<br />and Grantor(s) agree to limit and preclude the use, improvement and
<br />development, under the conditions and covenants herein contained,
<br />the following described Land in the County of Hennepin and State of
<br />Minnesuta:
<br />That part of Government Lot 1, and that part of Lydiard Lake which lies
<br />within the Northeast Quarter of the Northwest Quarter of Section 36, Township
<br />118, Range 23, which lies easterly and northeaster ' of the following
<br />described line:
<br />Commencing at the northwest corner iid Government Lot 1; thence North 890
<br />44' 42" Fast, assumed bearing, along c.ne north line of said Government Lot 1,
<br />a distance of 472.96 feet to an United States Meander Corner on the north line
<br />of said Government Lot 1, said corner being the point of beginning of the line
<br />to be described; thence South 570 30' 00" West a distance of 198.00 feet;
<br />thence South 140 30' 00" West a distance of 264.00 feet; thence South 610 30'
<br />00" East a distance of 462.00 feet; thence South 730 00' 00" East a distance of
<br />264.00 feet; thence South 610 00' 00" East a distance of 396.00 feet; Lhencc
<br />South 710 001 00" East a distance of 93.27 feet to a point in the east line of
<br />said Government Lot 1 distant 454.06 feet north of the southeast corner of saic
<br />Government Lot 1 and there terminating.
<br />as follows:
<br />1. Grantor(s) hereby covenant and agree (s):
<br />A. No structures shall be constructed, erected, or Placed
<br />upon, above, or beneath the Land including without limitatio:1, fences,
<br />fireplaces, steps, docks, piers, hardcover or roads of any nature
<br />whatsoever, or any other structure or improvement inconsistent with
<br />the natural state of the Land.
<br />B. No trees, shruts or other vegetation shall be destro eci,
<br />cut or removed from the Land except as authorized by writter consent
<br />of Grantee.
<br />C. No earth, loam, peat, gravel, soil or any other natural
<br />material or substance shall be moved or removed from the Land and
<br />there shall be no dredging or excavation of any nature whatsoever or
<br />any change of the topography of the Land without the written consent
<br />of Grantee.
<br />D. No soil, sand, gravel or other substance or material as
<br />landfill shall be placed, dumped or stored upon the Land and no waste,
<br />trash or garbage shall be placed, dumped or stored upon the Land.
<br />E. No use shall be made of the Land except uses, if any,
<br />which will not change or alter the natural condition of the Land,
<br />and no use which would tend to charge the drainage, flood control,
<br />water conservation, erosion control, soil conservation, fish a,id
<br />wildlife habitat characteristics ,Fall be ma,?c of the Land or the
<br />water situated thereon.
