purposes in Countryside Manor 2nd Addition and <br />additional subdivisions of Outlot A, Countryside <br />Manor 2nd Addition. In the alternative, an <br />amendment of Declaration of Covenants, Conditions <br />and Restrictions executed by DiCor,, dated August <br />20, 1982, filed September 1, 1982 as Document No. <br />1479976, files of the Registrar of Titles may <br />incorporate such restrictive covenants concerning <br />said outlots. The declaration of covenants, <br />conditions and restrictions or the amendment of <br />the declaration of covenants, conditions and <br />restrictions Document No. 1479976 shall be in fore <br />satisfactory to the City. Such declaration or <br />amendment of declaration shall contain the consent <br />of each mortgagee to the filing of the declaration <br />or amendment to the declaration stating that <br />should the mortgagee foreclose its mortgage oa the <br />Property or take a deed in lieu of foreclosure, <br />the mortgagee will take title to such declaration <br />or anenued declaration. <br />d. All necessary parties will execute and deliver to <br />the City a road and utility easement over Manor <br />Circle when replatted as an outlut which road and <br />utilities easement sija]1 grant to the City an <br />easement for public ingtess, egress, access, road <br />and utilities purposes in form satisfactory to the <br />Ci :y. <br />3. Upun all of the terms and conditions described in <br />paragraph 2.a-d being met, the City agrees to vacate Manor Circle <br />and to execute such document as may be required to release Dicon <br />and points West and their successors and assigns from the <br />ooiiyations under this agreement. <br />4. DiCon and/or points West or their successors and <br />assigns agree to execute and deliver to the City a temporary road <br />and utility easement for a cul de sac at the end of the portivi of <br />Manor Circle to be constructed at the present time or any <br />extension thereof prior to the replat of Manor Circle as an <br />outiot.
