CITY OF RICHFIEiD, MINNESOTA <br />Office of City Mz.nager <br />Council Letter No. 169 <br />Agenda Hay 14; 1984 <br />The Honorable Mayor <br />and <br />Members of the City Council <br />City of Richfield <br />Subject: Ordinance Amendment To Permit Mobile Vending <br />Vehicles in Residential Neighborhoods. Second <br />Reading. <br />Council Members: <br />Blue Bell Ice Cream, Inc. has submitted a request to operate a <br />mobile ice cream and concession business in Richfield. 4 <br />representative of Blue Bell appeared before the city council at <br />its meeting of April 9, 1984, and agreed to comply with several <br />city restrictions if d license to operate the mobile ice cream <br />vehicle would be approved. The agreed upon restrictions are: <br />1. Tr, v-,hicle would not be operated on July 4; <br />2. The vehicle will not sell products on arterial streets; <br />and <br />3. The operator of the vehicle will not compete with <br />concession stands operated in the city parks. <br />At the April 23, 1984 city cou-ail meeting, the city council <br />approved on first reading, an amendment tc Chapter VI, Section <br />6.14 of the Code of Ordinances entitled "Sound Trucks" as follows: <br />1. An amendment to subdivision 1 expands upon the defini- <br />tion of a broadcast vehicle by including vehi.'r that <br />have "any unamplified projection of sound for {.r.e pur- <br />pose of attracting atter.tic.r to a commercial enterprise <br />whether or not conducted in or on such vehicle." The <br />amendment permits the Blue Bell Ice Cream truck to be <br />included under the broadcasting tyke vehicle which is <br />permitted in Richfield; and, <br />2. The second amendment amends subdi. Lion 6 by providing <br />th;t a broadcasting vehicle may operate in resi,iential <br />areaz of the city if granted special permission by the <br />city council with: the added pr;;viso that the council <br />if it wishes to grant special permission may place certain <br />cor,ditic,rs ano restrictions or, the activity %�-ncerning t e <br />mobile icp cream vehicle. <br />
