8) And the applicant agrees in writing to any conditions that the city council deems appropriate <br />for the use, including a requirement for a financial security to ensure removal of all evidence of <br />the use upon termination, and restoration of the site to prior or better conditions. The <br />conditions shall be set forth in a development agreement between the property owner and the <br />city, which agreement shall be recorded with the Hennepin County Recorder or Registrar of <br />Deeds. Approval of the Interim Use Permit will be memorialized through a resolution <br />that will be recorded against the property. All requirements and conditions will be listed <br />as part of the resolution. This criterion is met. <br />SITE PLAN ANALYSIS (6.12.750) <br />Before granting approval of the site plan review, the city council or the planning and zoning coordinator <br />shall determine that the proposal: <br />1) Is compatible with surrounding land uses; The current land use (public boat launch) is an <br />existing condition and is a legally nonconforming use. The proposed improvements <br />support the existing use. <br />2) Preserves existing unique and natural features of the site and minimizes impacts to wetlands, <br />floodplains, and shoreland areas; The proposal will preserve and improve the natural <br />features of the parcel by improving the stormwater management, removing invasive <br />plantings, and installing new native landscaping. The existing use as a public access point <br />for Lake Minnetonka will be maintained. <br />3) Creates harmonious relationship of buildings and open space with natural site features and <br />with existing and future buildings having a visual relationship of the development; The site <br />has minimal building and structural improvements. The site supports access and use of <br />Lake Minnetonka for the public. As proposed, the application will provide screening of <br />the site with fencing and new plantings to promote a protect view for portions of the site. <br />4) Achieves a safe and efficient vehicular and pedestrian circulation system; The proposed <br />application will reorient the parking lot and install walking paths for pedestrians. These <br />improvements promote safety for vehicle and pedestrian circulation within the site. <br />5) Places no excessive demands on services and infrastructure, including local streets; The site is <br />accessed off of a County road. It should not create new demands on services from the <br />city. The County is responsible for the maintenance and improvements of the site. <br />6) Conforms to the city's plans for parks, streets, and walkways; No new parks, streets or <br />walkways are proposed outside of the subject parcel. The site supports public access to <br />Lake Minnetonka for a variety of users. <br />7) Conforms to the city's community management plan; The proposed development <br />improvements of the public boat landing support access to Lake Minnetonka which is <br />consistent with the community management plan for a Park and Recreational Space. <br />8) Achieves a maximum of safety and convenience of vehicular and pedestrian movement; The <br />redesign promotes safety for vehicular and pedestrian access throughout the site. <br />9) Incorporates sufficient landscaping to reasonably screen undesirable features and to enhance <br />the image of the development; The applicant has submitted landscape and lighting plans to <br />mitigate views for the abutting properties and limits activities on the site. <br />10) Protects abutting properties and does not create detrimental disturbances to surrounding <br />properties; The site will be screened from the residential properties to the west with new <br />26 <br />
