City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />d) Relocating the garage entrance to a point 24 feet <br />from the street right-of-way will result in a safer <br />access for the garage. <br />e) The topography of the lot makes the relocation of the <br />garage feasible only with alterations in grade on the <br />east side of the house. <br />f ) The property is severely limited by the existing lot <br />size and the existence of lakeshore subject to the <br />pertinent regulations on two sides of the property. <br />4. The applicant has revised his original Droposal in <br />accordance with the Planning Commission recommendation of a <br />maximum allowance of 30% hardcover in the 75-250' setback <br />zone, and has provided suitable landscape and drainage plans <br />for the project. <br />5. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />6. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally to <br />other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to <br />preserve a sutstantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive'Plan of the City. <br />CONCLU.;IONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.22, <br />Subdivision 2 to allow the construction of an addition and attached <br />garage with driveway, ewalks and retaining walls which will <br />increase the hardcover ,485 square feet or 30% in the 75-250' <br />lakeshore setback zone 25% hardcover is normally allowed, and a <br />variance to Section 10.2. Subdivision 6(B) to allow a street setback <br />of 24' instead of the 30' setback normally required, subject to the <br />following conditions: <br />
