City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />CITY <br />NO. <br />OF <br />•-• • <br />A RESOLUTION BY THE CITY OF ORONO SETTING A SPEED <br />LIMIT OF 30 MPH ALONG WILLOW DRIVE FROM FOX STREET <br />TO THE BURLINGTON NORTHERN RAILROAD BRIDGE AND <br />INDEMNIFYING THE MINNESOTA DEPARTMENT OF <br />TRANSPORTATION FROM ANY CLAIMS AS A RESULT OF <br />SETTING SUCH SPEED LIMIT <br />WHEREAS, the Minnesota Department of Transportation <br />(MnDOT) has approved and granted to the City, a variance from <br />Minnesota Rules §8820.3300 allowing a vehicle speed limit of 30 <br />mph on Willow Drive, from Fox Street to the Burlington Northern <br />Railroad Bridge; <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of <br />the City of Orono: <br />1. The vehicle speed limit along Willow Drive from Fox <br />Street to the Burlington Northern Railroad Bridge shall be set at <br />30 miles per hour, rather than 40 miles per hour as stated in <br />Minnesota Rules #8820.3300. <br />2. As a condition of MnDOT granting its variance, the <br />City will hold harmless the State of Minnesota and all its agents <br />and employees of and from any and all claims, demands, actions or <br />causes of actions of any nature or character arising out of or by <br />reason of, in any manner, the resurfacing project on MSAS 191 <br />(Willow Drive) from Fox Street to B.N.R.R. Bridge, in any other <br />manner than as a design speed of 40 miles per hour in accordance <br />with the Minnesota Rules ,$8820.3300, and further agrees to defend <br />at their sole cost and expense any action or proceeding commenced <br />for the purpose of asserting any claim of whatsoever character <br />arising as a result of the variance. <br />Adopted by the City Council of the City of Orono, <br />Minnesota, of a regular meeting held February 25, 1985. <br />Mary C.
