#886 Ragatz <br />Page 2 <br />February 4, 1985 <br />Both neighbors have indicated they have no objection to the proposal, <br />although the proposed deck with railings does extend past the average <br />setback line. <br />At the January 21, 1985, Planning Commission meeting, applicant stated <br />that he has previously removed approximately 150'-200' of existing <br />concrete sidewalk hardcover within the 0-75' setback area. <br />Planning Commission recommended approval conditioned on favorable <br />findings by the City Council regarding decks as non -hardcover. <br />Findings for approval recommended by Planning commission include: <br />1. No view problem would be encountered. <br />2. The proposed deck only extends lakeward as far as the <br />extension of the west line of the house to the south. <br />3. The location of an existing Box Elder tree and the house to <br />the south are factors which limit the acceptable locations for <br />the proposed deck. <br />4. The location of applicants existing house poses a problem <br />in locating a suitable deck. <br />5. Applicant has stated he has removed 150-200 sf of existing <br />hardcover walkways in the 0-75' zone. <br />Conditions recommended by Planning Commission include restrictions on <br />additional future hardcover. <br />Staff notes that applicant has not discusseO specific methods he would <br />use in creating a deck that is not hardcover. The standards set forth <br />in the Krutzig Custom Homes resolution (File 0881 ) could apply to the <br />Ragatz application. Regardless, hardcover in the 75-250' zone will <br />still be less than 25 percent. <br />Tne main issue, then, is whether to allow a deck of any specifications <br />to be placed in the 0-75' zone, where no structures are allowed. Decks <br />are considered as structures. Dons the presumed removal of 150-200sf <br />of sidewalk in itself justifyallowingan eqval area of deck structure? <br />Do any other hardships present themselves as justification for the <br />deck, as you found on the Steve Pauly application on Dahl Road? <br />Applicant's landscape architect has submitted an article regarding <br />decks for your perusal. <br />A resolution reflecting Council's action will be p.-epared for the next <br />Council meeting. <br />
