Motion, Ayes (5), Nays (0). <br />INTERPRETATION OF SECTION 10.60 <br />FUBDIVISION 13 - EXTERIOR STORAGE <br />IN "R" DISTRICTS Zoning Administrator Mabusth reviewed the exterior <br />storage section of the code and asked for <br />r:onformation of the intent and correct in*erpretation <br />of performance standards. Mabusth stated this was <br />probably the intent of the ordinance. You are <br />allowed to have mobile equipment if you keep it fully <br />screened --that covers the boat that is over 20 feet <br />in length. The boat that is 20 feet or less is a <br />non -encroahiner.t not requiring to be screened but you <br />could Set it 10 feet off the side lot line and 10 <br />feet off the street_ The Supreme Court has defined <br />the lakeshore yard as the front yard and the rear <br />yard as the street yard, <br />City Attornoy Radio seated this interpretation is <br />reasonable. The only problem could be if we only <br />respond to neighbors complaints. That places too <br />much power in the hands of the nei(phbors. The <br />discretiorh nust lie with the enforcer of that <br />ordinance. The Zoning Administrator should take into <br />accounC the complaints and cotnmeot5 ok, th•� reighbors, <br />but the final di.scretiun nust rest with the Zoning <br />kdministrator. <br />Mavor Butler stated the Council agrees with this <br />in ,.pretation of the ordinance. <br />Art By►ne, 3315 Crystal Bay Road, stated to the <br />^ouncil that he would volunter_r to negotiate between <br />*tr. Johnson and Mr. Wheeler if it would please the <br />^,c,unci 1 and Mr. Wheeler. <br />4r.
