3. <br />No suit or action shall be commenced hereunder by any claimant: <br />(a) Unless claimant shall have filed a public contractors bond claim <br />in the form and within the time provided under applicable law, or <br />(b) After expiration of time for enforcement of a public Contractors <br />bond claim by legal action. <br />4. <br />The amount of this bond shall be reduced by and to the extent of any <br />payment <br />or payments made in good faith hereunder. <br />5. <br />The Contractor and Surety shall keep the Project free and clear of <br />liens and shall promptly remove any and all liens filed against the Project by <br />claimants. <br />A <br />6. <br />The Obligee's right of action on this bond, or for the breach thereof, <br />shall not be limited by the conditions set forth in paragraphs 1 through 3 <br />above. <br />F <br />Ito <br />#.
