City <br />Attorney Ra(lio stated that would be in the civil suit <br />and you would ask the court to allow you to go on the <br />property either that or you'd ask the court to direct <br />the individual to clean it up and if they didn't <br />they'd be in civil contempt. <br />Russ Norum state1, t believe that the County Attorney <br />recognizes that th-e threat of criminal action is for <br />not doin3 something, but that is not the proper way <br />to do that. My understandin., is you can never <br />threaten criminal action, you can remind the person <br />that it is available and necessary buy the way the <br />motion read instructing you to take criminal action <br />if she doesn't carry out -that's not proper. <br />City Attorney R•31io state,] this is 110t i threat that <br />it is 3 sttto�n,�Iit of direction from the City Council. <br />Mayor Rutler stated the City Attorney does nothing <br />without the direction of the City Council. This <br />serves its fair notice to both you and he of what's <br />doing to be coming up in the future if other things <br />are not done. <br />L. Adams asked if some attention should be given to <br />t;tr question o` 4hether or not a business is being <br />operated there. <br />Mayor Butler reminded Mrs. Rossing that if sit 5 <br />running a business that she should talk to Jeo, <br />Mabusth about getting the required business license. <br />BUILDING AND ZONING DEPARTMENT <br />ANNUAL REPORT 1984 Zoning Administrator Mabusth stated this is the firat <br />time that tho revenues have exceeded the <br />expenditures. <br />FENCE ORDINANCE <br />AMENDMENT Zoning Administrator Mabusth stated she felt the <br />height limitations are more clear and the addition of <br />existing grade has been ma:ie in the appropriate <br />sections. <br />Council discussed the definition of existing grade. <br />Mayor Butler moved, Councilmember L. Adams seconded <br />to approve Ordinance Number 9, Second Series, An <br />Ordinance. Amending Performance Standards to the Non - <br />Encroachment and Accessory Structure Sections of the <br />Orono Municipal Code as amended to read originAl <br />
