City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION VACATING AN UNUSED PORTION OF <br />PARK AVENUE WITHIN THE PLAT OF BERGQUIST AND <br />WICKLUND'S PARK, SECTION 7, TOWNSHIP 11, RANGE 23 <br />IN CITY OF ORONO, MINNESOTA <br />WHEREAS, The City of Orono is a municipal corporatic:-ri <br />organized and existir.9 under the laws of the State of Minnesota; <br />and <br />WHEREAS, on July 25, 1984, I.D. Caples and Virginia A. <br />Caples filed a petition with the City of Orono requesting the <br />vacation ofa portion of Park Avenue originally dedicated in the <br />plat of Bergquist and Wicklund's Park legally described as <br />follows: <br />That part of Park Avenue lying East of <br />the West line <br />of Lot <br />10, Block 3, and its <br />Northerly extension, <br />and <br />Ijing <br />Northwesterly of a line <br />drawn front the <br />most Southerly <br />corner <br />of Lot 9,said Block 3, <br />Northeasterly through a point <br />on the <br />Northeasterly line <br />of said Lot <br />9 distant 15 <br />feet <br />Northwesterly from the Easterly corner <br />of said Lot 9, <br />all in <br />"Bergquist & Wicklund's <br />Park, Hennepin <br />Co. Minn"; and <br />WHEREAS, after due published and posted notice, a <br />public hearing was held before the City Planning Commission on <br />August 20, 1984, regarding said vacation and all persons <br />interested were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the <br />Planning Commission recommended approval of the requested <br />vacation and the Council of the City of Orono finds that said <br />vacation, as proposed, is in keeping with the public interest in <br />consideration of the following findings: <br />1. The vacation does not affect access to or use of any <br />adjoining property. <br />2. The City has not and does not intend to develop, impr;,ve <br />or use the dedicated right-of-way as a road except for <br />utilities and access purposes hereinafter described. <br />3. The unimproved dedicated right-of-way as it ex.. <br />serves no public purpose. <br />
