MINUTES OF THE REGULAR COUNCIL MEETING HELD JANUARY 14, 1985 PAGE 2 <br />1. Direct the staff to ticket Mr. Johnson for his <br />violations like the City is doing in a Similar case <br />involving Mr. Eller. Wheeler suggested then <br />letting Johnson decide if he wants to come in and <br />appropriately pay the building permits and apply <br />for variances. <br />2. Wheeler told Council if they dl lji't want to do the <br />above, he asked that his name officially be put on <br />the Planning Commission agenda for January 21, <br />1985, at which time the Eller dispute will be on the <br />Planning Commission agenda. <br />Wheeler asked that his name be placed on the agenda in <br />order to tie-in his case with a similar case like the <br />Eller case. <br />City Attorney Radio told Wheeler that he was informed by <br />City Staff that if he wished to be placed o,. the Planning <br />Commission Agenda to appeal the decision of the Zoning <br />Administrator, that he is welcome to do that on his own <br />by paying a fee to appeal this decision. Radio stated <br />in fact that the Council has an ordinance in front of <br />them tonight that will increase that appeal application <br />fee from $100 to $200. <br />Jerry Wheeler informed Radio that this was not correct. <br />Wheeler stated that fie was told by Zoning Administrator <br />Mabusth that a decision had been made on this at the <br />Council meeting of last year. Wheeler stated that when <br />he appeared at the last Council meeting, Mayor Butler <br />stated that if he continued to push the matter of the <br />bout, that she would unilaterally give Mr. Johnson a <br />variance for his boat and storage of truck. Wheeler <br />explained that when he talked to City Attorney Radio, <br />Radio informed him that he must appeal the inaction of <br />the City staff and pay a $100 fee. <br />Mayor Butler replied that hardcover was not discussed <br />at the last meeting when Wheeler was present. <br />Jerry Wheeler stated it appears that if an individual is <br />not liked by the City staff or by someone on the City <br />Counci 1 , that if this party goes into apply for a <br />building permit and gets denied, that this party would <br />have to pay a fee to appeal the decision of the staff <br />person. Wheeler asked that the City enforce their laws <br />equally. Wheeler told Council if they were going to <br />ticket Mr. Eller and ask him to come in for variances, <br />then any other citizen should have the same treatment. <br />
