Many of <br />these homes are located along the shoreline of Lake Minnetonka. <br />The B&B use may be one approach to this problem, certainly nct <br />the only solution. I would concur with the Stillwater staff that <br />a limit would have to be placed on B&Bs within a City. If we go <br />the Conditional Ilse Permit route, you may not place limits on <br />their nur.:k,Ar. We may have to opt for licensing or franchising <br />where limits are permitted. I have discussed this concern with <br />the City Attorney's office and they concur. The City Attorney <br />wi l review the question of Municipal licensing and report his <br />findings at a later date. <br />The Attorney has also confirmed that performance standards <br />can also be established for license applications. <br />Options of action available to Council: <br />a. To deny the appeals petition of Thomas & Kristi Kaul finding <br />a conflict with the original intent and scope of the Home <br />Occupation Section of the Cor?e and the B&B use not permitted as a <br />Home Occupation. <br />1. And to direct staff to draft a resolution of denial and <br />to further advise the applicants that a B&B use would not be <br />compatible in a residential zone and to be in complete <br />conflict with the intent of the residential zoning <br />districts of the City. <br />or <br />2. Direct staff to draft a denial resolution of the appeals <br />petition and to further direct the Planning Commission to <br />study and make recommendations to the Council regarding a <br />proposed am-ei.3ment of the code that would al low a B&B use in <br />a residential district either via a license or a Conditional <br />Use Permit and *o address the following issues in <br />performance standards: <br />1. Sewer capacity or adequate land area for drainfield <br />to sustain subordinate + principal use - need to secure <br />area for future septic expansion. <br />2. Use must be located in principal rest ace of <br />owne.;'operator. <br />3. Limit on number of bedrooms - guests. <br />4. Additional signage limit side of Section 10.61, <br />Subdivision 2 A, B & C. <br />5. Required screening for off street parking • 1 off <br />street parking space for each bedroom unit. <br />6. Use not to be . _ sed in local papers. <br />
