0 r RESOLUTION NO. 895 . A RESOLUTION APPROVING THE PLAT OF THE NURSERY WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by George Jackson and Kelley & Kelley, Inc., the subdivider; and WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including Dedication of required drainage and utility easements Dedication of access easements underlying private roads Payment of a park dedication fee of $2,000.00 NOW, THEREFORE, BE IT RESOLVED, that the City Council of • the City of Orono hereby approves the plat of THE NURSERY, Hennepin County, Minnesota; subject to the following conditions: 1. Execution of a developer's agreement for road and drainage installation. 2. The aforesaid plat shall be filed with the Hennepin County Recorder's Office on or before September 13, 1978, together with a certified original copy of this Resolution. 3. The private road, Outlot C and Outlot D, shall hereafter be known as Nursery Road. 4. Kelley & Kelley Division Outlot A shall be legally combined with Lot 7. 5. The Nursery Outlots A & B shall each be legally combined with an adjacent lot in this or another division. 6. Upon completion of Torrens proceedings on the underlying Kelley and Kelley Division, the subdivider shall deliver to the City and record in the chain of title of this plat a private road access easement, a maintenance and ownership agreement for the road and drainage facilities, and a drainage and utilities easement according to the standard City format. 0
