0 <br />r <br />RESOLUTION NO. 895 <br />. A RESOLUTION APPROVING <br />THE PLAT OF THE NURSERY <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development <br />of land within the City; and <br />WHEREAS, the City Council has considered the application for <br />a subdivision plat by George Jackson and Kelley & Kelley, Inc., the <br />subdivider; and <br />WHEREAS, the subdivider has completed all requirements of <br />the platting regulations of the City, including <br />Dedication of required drainage and utility easements <br />Dedication of access easements underlying private roads <br />Payment of a park dedication fee of $2,000.00 <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br />• the City of Orono hereby approves the plat of THE NURSERY, Hennepin <br />County, Minnesota; subject to the following conditions: <br />1. Execution of a developer's agreement for road and drainage <br />installation. <br />2. The aforesaid plat shall be filed with the Hennepin County <br />Recorder's Office on or before September 13, 1978, together <br />with a certified original copy of this Resolution. <br />3. The private road, Outlot C and Outlot D, shall hereafter be <br />known as Nursery Road. <br />4. Kelley & Kelley Division Outlot A shall be legally combined <br />with Lot 7. <br />5. The Nursery Outlots A & B shall each be legally combined <br />with an adjacent lot in this or another division. <br />6. Upon completion of Torrens proceedings on the underlying <br />Kelley and Kelley Division, the subdivider shall deliver <br />to the City and record in the chain of title of this plat <br />a private road access easement, a maintenance and ownership <br />agreement for the road and drainage facilities, and a drainage <br />and utilities easement according to the standard City format. <br />0 <br />
