RE.SO1.U1Io!1: i <br />A RESOLUTION APPROVING THE VACATION OF <br />OAK PLACE <br />WHEREAS. pursuant to due and proper notice according to law <br />a public nearing was held by the Village Council at the Village Hall LI <br />the Village of Orono, Minnesota on May 12, 1969 at 7:30 P.M, tc consider <br />the vacation of Oak Place, described as follows: <br />Block 6 and Block 79 Saga Hill Revised <br />Section - Township 117 • Range 23 <br />WHEPEA5, no Y►ublic intent would be served in the predictable <br />future by keeping 7ak Place as a Village road, <br />WHEREAS, the Village Council t:s determined the vacation of the <br />said street is in the best interests of the Village; <br />NOW, THEREFORE, IT IS RESOLVED that the ahove described st-sae*. <br />is hereby vacated. <br />BE IT FURTHER RESOLVED that such vacation shall not affect the <br />right of the Minneapolis Gas Company its successors or assigns, to enter <br />upon that portion of t,%e aforudescri�ed Oak Place which is described as <br />follows, to -wit: <br />The Easterly and Southeasterly 20 fee,, as measured at <br />right angles to the Easterly and Southeasterly lines <br />thereof, of all that past of Oak PlacK:, vacated, lying <br />between Blocks 6 and 7, Saga Hill Revised, excepting <br />therefrom all that part of said Oak P':ace' vacated, <br />lying Southwesterly of a line drawn parallel with and <br />distant 25 feet Southeasterly of the Hortheasterly line <br />extended of Lot 8, said Block 7, Saga Niel Revised <br />to operate, maintain, repair, replace, alter, inspect or remove its gas <br />stains and appurtenances thereto located therein and said right is hereby <br />expre=sly reserved to said corporation, its successors and a0rigns, and' <br />no other parson or corporation shall have the right to fill, excavate <br />eruct buildings or other structures, pla- trues or perform any act which <br />would interfere with or obstruct access to said gas mains upon or within the <br />�nre described area without first 00taining the written approval of said <br />corpration authorizing it to do so; <br />Adopted by the Village Council of the ?pillage oti Orono, Minnesota at a <br />regular meeting geld Sept -..per 2d, 1973. <br />..user; T ay& <br />.Attest: <br />
