RESOLUTION NO. 862 <br />A RESOLUTION DENYING THE VARIANCE REQUEST OF <br />HARRY GUSTAFSON, 2515 KELLY AVENUE <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, the City Council of the City of Orono has adopted <br />zoning regulations and building regulations for the orderly, <br />economic and safe development of land within the City consistent <br />with the adopted Comprehensive Land Use Plans; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />floodplain and conservation regulations for the protection and <br />preservation of the lakes, wetlands shoreline and conservation <br />areas of the City consistent with the adopted Storm Water <br />Management Plan; and <br />WHEREAS, the Planning Commission and City Council have , <br />reviewed the variance request of Harry Gustafson to allow for the <br />expansion in bulk of an existing boat house located on his property' - <br />at 2515 Kelly Avenue. <br />NOW, THEREFORE, BE IT RESOLVED, that based upon all of the <br />information presented by the applicant and the reports of the <br />City staff and Planning Commission, the City Council hereby denys <br />the variance request for the following reasons: <br />1. The existing building is entirely within the lakeshore <br />conservation and floodplain area. <br />2. The proposal would be a major addition of an entirely <br />new story above the existing structure. <br />3. The proposal would intensify the use of the <br />non -conforming structure. <br />4. The proposal would increase the bulk of -the <br />non -conforming structure. <br />5. The proposal would -tend to prolong the existence of <br />the non -conforming structure. <br />6. The proposal would tend to be a visual obstruction <br />within the lakeshore conservation area rising above <br />. the adjacent lawn level where the existing structure <br />is flush with the adjacent lawn level. <br />
