RESOLUTION NO. 854 <br />. RESOLUTION REQUIRING M1OVAL <br />OF PRIVATE ENCROACHMENTS <br />WITHIN THE RIGHT-OF-IVAY OF <br />MINNETONKA AVENUE <br />UHEREAS, the City of Orono is a municipal corporation organized and exist- <br />ing under the laws of the State of Minnesota; and <br />1VHEREAS, one of the duties of the City is to control and maintain all <br />dedicated street rights-of-way for the benefit and use of the public; and <br />IgIEREAS, it has been brought to the attention of the City Council the <br />existence of certain private structures erected on and encroaching within the <br />platted right-of-way of Minnetonka Avenue; and <br />WHEREAS, the owners of said structures have agreed to remove same at <br />no cost to the City prior to January 1, 1978; <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono <br />hereby requests and directs the following persons to remove their structures from <br />within the public right-of-way prior to January 1, 1978, and be it further resolved <br />that any relocation of said structures onto private property is subject to all the <br />current building code and zoning code requirements established for the protection <br />of the health, safety and general welfare of the citizens of Orono. <br />• 1. Mr. & Mrs. Lawrence Quast - 1251 Briar Street: <br />Removal of one nine foot by twenty-four foot wood frame <br />shed or chicken coop and miscellaneous fencing located <br />on the extension of Minnetonka Avenue west of Briar <br />Street. <br />2. Mr. & Mrs. Frank Peterson - 2170 Minnetonka Avenue: <br />Removal of one ten foot by nineteen foot wood frame <br />garage and miscellaneous temporary wire fencing located <br />on the extension of Minnetonka Avenue west of Briar <br />Street. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular meeting <br />held November 14, 1977. <br />William B.
