APPENDIX: REVIEW CRITERIA <br />INTRODUCTION <br />The Waste Management Act (WMA) authorizes the Metropolitan Council to review <br />and approve the following: <br />o Waste Facility Permit Applications; <br />o Waste Supply and Processing Contracts; <br />o Waste District Proposals; <br />o Waste Flow Designation Proposals; and <br />o Certificates of Need <br />The Council will use the review mechanisms as one method to implement the guide <br />chapter. Criteria are provided in this section for conducting the reviews with <br />the exception of certificates of need (CON). Review criteria for CONS will be <br />added to the guide chapter after the Council approves required revisions to <br />county solid waste master plans. <br />Prospective applicants are encouraged to contact the Council before preparing <br />and submitting review requests. The information and data necessary for the <br />review can be discussed. <br />WASTE FACILITY PERMIT APPLICATIONS <br />OVERVIEW <br />A waste management facility consists of all property and easements used to <br />store, process and dispose of solid waste. Waste facilities include transfer <br />stations, storage facilities, land disposal sites and waste processing facili- <br />ties such as resource recovery facilities (Minn. Stat., sec. 473.121, subd. <br />29). They do not include property used to collect waste of facilities used to <br />process scrap metal, paper, glass or other materials separated from the mixed <br />waste stream. <br />Council approval is required before a waste facility in the Metropolitan Area <br />can be issued a permit to operate by the MPCA. The Council has 60 days to <br />reach its decision, unless a time extension is granted by the MPCA. In its <br />review the Council can specify conditions to be incorporated by the agency's <br />permit. <br />To obtain Council approval, permit applications for proposed waste facilities <br />must be consistent with the criteria in this section of the guide chapter. The <br />WMA rquires the Council"s plan for solid waste management to include criteria <br />that address the following aspects of proposed waste facilities: <br />o Waste Management Service Impacts; <br />0 Capacity; <br />o Processing Techniques; <br />W <br />
