PAGE 10 <br />Gerhardson stated that i couple of years ago the City <br />replaced the culvert and created a ponding area for the <br />drainage. Gerhardson stated that the Jentilucci's <br />want something done with the tile line. <br />Alex Jentilucci of 1295 Briar Street showed the Council <br />pictures of the drainage problem. Jentilucci noted <br />that the drainage ditch is being used by all of Crystal <br />Bay, approximately 10 acres. Jentilucci noted that <br />the City did put in the drainage ditch and the City <br />should have to maintain the "'itch. Jentilucci stated <br />that at one time the City was maintaining the ditch and <br />then quit the maintenance of the ditch after replacing <br />the culvert a couple of years ago. Jentilucci asked <br />the City to take care of the problem and clean out ditch <br />area. Jentilucci noted that all he wants is the street <br />to disappear from his survey. <br />Jan Johnson of 2170 Prospect Avenue stated that she used <br />to call the City to come and clean out ditch area. <br />Johnson stated that when she stopped calling the City <br />Stopped maintaining the ditch area. <br />Margaret Curtis of 2180 Prospect Avenue stated that the <br />City caused the water flow problem when the City <br />replaced the culvert. Curtis stated that the City put <br />in the culvert along time ago and the City should have to <br />maintain it. <br />Councilmember Adams explained that Dayton has been told <br />by the City to maintain his end of the culvert, and the <br />neighbors here should have to maintain their end. <br />Adams noted that this is private property. <br />Diane Jentilucci of 1295 Briar Street stated that the <br />City should clear up their legal description problem. <br />Mayor Butler asked there are other people with drainage <br />problems ir. the City that would want their problems <br />solved if the City was to maintain this culvert. <br />Butler also asked the City Attorney to research to see <br />if the City would be setting an adverse precedent by <br />taking over the maintenance of this drainage tile. <br />Public Works Coordinator Gerhardson stated that there <br />are several other drainage problems in the City. <br />City Attorney Radio asked that the matter be tabled so <br />that he may do a review and submit a legal opinion to the <br />Council. Radio noted that this could be settiny an <br />adverse precedent if the City was to take over <br />maintenance of this when it is on private property. <br />Radio noted that it is not up to the City to clear up <br />Jentilucci's legal description. <br />
