â– ACTS <br />Plaintiffs James Littlefield and Bonnie Littlefield, <br />purchased a 19.3 acre parcel of land in Afton, Minnesota on <br />August 26, 1983, In order to construct a residence, plain- <br />tiffs sought to obtain a building permit from the City of <br />Afton. In their quest for a building permit, plaintiffs had <br />to attend a aeries of meetings. The final meeting plaintiffs <br />attended was the October 18, 1983 Afton City Council meeting. <br />The Council concluded that it would grant plaintiffs a <br />building permit if plaintiffs complied with ^ertain condi- <br />tions. The most salient condition being that plaintiffs <br />convey a public right of way to a nearby parcel of land owned <br />by Zoning Administrator Helen Baker and her husband, and <br />Mr. and Mrs. Robert Fritz. At present, the City is willing <br />to grant plaintiffs z building permit if plaintiffs convey <br />the right of way to the Bakers end Fritzes. S 1983 action <br />shortly after the October 18, 1983 City Council meeting. <br />Plaintiffs are suing the City, all the members of the City <br />Council, and Zoning Administrator Baker. Plaintiffs allege <br />that the denial of their building permit application was <br />without due process of law and that the requirement of <br />conveying a public right of way constitutes a taking without <br />- 2 _. <br />
