City of ORON& UNCIL MEETING <br />RESOLUTION OF THE CITY COUNCIL NOV 1 "' ',��44 <br />NO. <br />CITY OF ORONO <br />V RESOLUTION DENYING AN APPEALS APPLICATION <br />THAT WOULD EXEMPT THE DIVISION OF <br />LEC"•LIY COMBINED LOTS FROM THE SUBDIVISION REGULATIONS <br />OF THE CITY GAP CIRONU <br />WHEREAS, per- Section 1(.).Cr6 Subdivision 2 John Ericson <br />(hereafter - "applicant") filed an appeals application with the <br />City that sought to clarify the application of the subdivision <br />regulations of the City in the division of applicant's legally <br />combined lots described as Lot 3, Lot 4 and the south 5 feat of <br />Lot 2 Shradywood according to the recorded plat thereof, Hennepin <br />County, Minnesota (hereafter "the property"); and <br />WHEREAS, the applicant was aware of the Orono City <br />Council's (hereafter "City)) year long study and #inal resolution <br />of the matter of requests to sell or separate contiguous cowered <br />substandard lots held in common ownership, that resolution would <br />afford lots under common ownership the same revirw precedure <br />provided for substandard lots held in single separate ownership; <br />c+nd <br />WHEREAS, the applicant was advised that Section li.lr', <br />66 Subdivision, Classification, Item 2 would require the filing <br />of a formal subdivision application if legally combined lots are <br />to be divided and that the proposed application would also <br />involve multiple variance applications; and <br />WHEREAS, thrr applicant filed an appeals application <br />6eel:inq direction from the City in order to determine if the <br />review procedure and per+orma.nce _tandardL established for <br />substandard lots owned in common would now apply tQ the division <br />of lots legally combined for tag: purposes; and <br />WHEREAS, tI[e City Council has considered the <br />applicant's appeals application, the recommendation of the <br />Planninq Commission, the written comments r.( the applicant's <br />attorney, the oral comments of both the applicant and <<pplicant's <br />attorney. <br />Page 1 of 55 <br />
