City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING A VARIANCE TO <br />14UNICIPAL ZONING CODE SECTION 10.27, SUBDIVISION 5(B) - FILE 1870 <br />WHEREAS, Gary Valenta (hereii.after "the applicant" ) is owner <br />of the property located at 1160 Townline Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />The Wcst 433 feet of the South 140 feet of the North 371.83 <br />feet of the Northwest quarter of the Southwest quarter of <br />Section 30, Township 118 North, Range 23 West of the 5th <br />principal meridian, subject to an easement over the west 33 <br />feet thereof (hereafter "property"); and <br />WHEREAS, the applicant has applied to the City for a variance <br />to Municipal Zoning Code Section 10.27, Subdivision 5(B)to permit the <br />construction of an attached garage 22 feet from the side lot line where <br />a 50 foot setback is required, and located 55' from the rear lot line <br />where a 100 foot setback is required. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as zoning file 9870. <br />2. The property is located in the RR-lA Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on October 22, 1984, and recommended approval of the proposed <br />variances based upon the following findings: <br />a) The existing topography and location of septic <br />system limits the possible locations for a garage. <br />b) The existing house was constructed on this 1.3 acre <br />lot prior to the current 5 acre zoning standards, and <br />the location of the existing house on the lot is a <br />hardship to the property. <br />4. The City Council has considered this appli.catioi, <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by t`,e applicant <br />and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />
