Coller stated that the <br />above findings in the case cited above are extremely <br />important and relevant to the Fisk case. Coller noted <br />findings that are unique to this property which include <br />the following: <br />1. Size and depth of the property. <br />2. Setback and character of the adjacent home. <br />3. Strict application of the ordinance would not <br />result in a more suitable neighborhood for the <br />neighbors. <br />Garth Coller stated that the current development in the <br />immediate area (Elm Street; Oak Street, Park Drive, and <br />Park Lane), zero .are over the one acre requirement of <br />the zoning district. Coller noted that zero are over <br />80-190 percent, one is between 60-80 percent, one is 40- <br />60 percent, one is between 20-40 percent. Coller <br />stated teat on Oak Street there are 6 developed units, <br />only one meets code requirements. Coller stated one is <br />between 80-100 percent, two are between 60-30 percent, <br />one is between 40-60 percent, and one is between 20-40 <br />percent. Coller stated that on Park Lane theta are 16 <br />units developed. Coller stated that zero are over the <br />code requirements, two are between 80-100 percent, one <br />is between 60-80 percent, four are between 60-80 <br />percent, and eight are between 20-40 percent. Coller <br />stated that in the same category as Fisk's lot, there <br />are 126 units in the LR-1B zoning district in the same <br />category. Coller noted there are 20 percent that are <br />in the same category or worse than the Fisk application. <br />Garth Coller introduced James Benschoof, traffic <br />analysist, to give expert testimony on the affect of the <br />traffic in the neighborhood if this lot was approved. <br />Jim Benschoof, traffic analysist, stated that he has <br />conducted a study of the traffic patterns in the <br />neighborhood. Benschoof stated that 11 existing <br />homes are served by Oak Street. Benschoof stated <br />approximately 110 trips per day would be made on Oak <br />Street. Benschoof stated that the Fisk home would <br />create about 10 more trips per day on Oak Street. <br />Benschoof stated that the intersection of Oak Street <br />and CR 151 has the capacity to handle the additional <br />trips of the Fisk dot and any other possible lots as <br />well. Benschoof stated that they addressed the <br />conditions on Oak Street where the lot would gain access <br />as to the ability of that segment cf Oak Street and found <br />that segment of the street will serve the lot <br />effectively. Benschoof stated that there is adequate <br />sight distance where the driveway would be located to <br />effectively serve the Fisk lot.
