PAGE 2 <br />#820 LONIE FISK Other Orono residents that were present for the Fisk <br />application were as follows: <br />David & Phyllis Fritz of 473 Tonkawa Road <br />Liedeke Larson of 458 Linden Avenue <br />Desyl Peterson of 4385 Chippewa Lane <br />Don Meyer passed out an original copy of his of fer for. <br />the Fisk's land to the Council. <br />Building & Zoning Administrator Mabusth stated that <br />Fisk asks for a lot area and lot width variance. <br />Mabusth stated an area variance of 75 N4.rcent and a <br />width variance of 13 percent. Mabusth stated that the <br />neighbors in opposition to this application were asked <br />to seek legal assistance. Mabusth s'.ated that the <br />neighbor's attorney has produced negative findin(js and <br />th<- neighbors have done a survey of vacant lots in the <br />LR-1B (one acre) zoning district. labusth stated teat <br />she has don- a survey of variance applications of lot <br />area and lot width variance that were denied 'back to <br />1977. <br />Administrator Mabusth stated that according to her <br />survey of lot area and lot width variances back to 1977, <br />3 variances were denied and 406 were appi ,ed. MabuSth <br />stated that approximately 7 or 8 applications were <br />withdrawn when it appeared that they were :doing to be <br />denied. Mabusth stated that those denials wz�re based <br />on the following findings: <br />1. Restricted building envelope. <br />2. Property n_ver assessed for sewer. <br />3. Stubs never provided. <br />4. Nssesso d rnar;at value suggests unbuildable 1:,t. <br />5. Land locked - inability to provide le-jal access. <br />6. Shape of lot. <br />7. Topography that would inhibit construction or safe <br />access to site. <br />Administrator Mabusth stated that Ron Batty, <br />neighbor's attorney, mentioned in his report of a self- <br />imposed hardship. Mabusth stated that she nas worked <br />with Mr. Fisk before on another variance application on <br />Baldur Park Road. Mabusth stated that she is not <br />suggestin,3 that he knows about the zoning code, but he <br />did work on a hardcover and setback problem application <br />(in Raldur Park. <br />
