MINUTES OF THE REGULAR ORONO COUNCi1, 4K-8-CING HELD OCTOBER 29, 1984. PAGE 18 <br />#811 Ericson 3. Lakeshore property is entitled to special <br />treatment. <br />Mayor Butler stated that the 1-'ity has never approved a <br />subdivision witl, variances. Butler stated that <br />lakeshore property is unique and that is why the City <br />has strict standards regaruiny hardcover. Butler <br />noted tsiat th-: one lot coniui-ns to the code now, but if <br />the City was to allow the division of the lot, the City <br />would be making two substandard lots which is against <br />the City's subdivision regulatioc.s. <br />Councilmember Frahm noted that the biggest detriment to <br />the lake is hardcover. <br />Bruce Goldstein stated that these are two separate <br />lots, so the City is not really talking about a <br />subdivision. <br />Mayor Butler stated that the lots were combined <br />according to Hennepin County. Butler stated that the <br />Ericson's have benefit-ta.l from tiie combination in that <br />the tax assessor assesses the value differently when <br />the lots are co no B.itler stated that, it i5 looked <br />upon as one developed lot. <br />Bruce Goldstein st•ited that tnT Ericson's have n:-vor <br />combined the lots. Goldstein stated that the Cuanty <br />probably thought it would be easier to send uat one tax <br />statement, than tao. <br />John Ericson stated that he has two separate legal <br />descriptions, but it is on one tax statement. Ericson <br />stated that he has a 65' lot and a 60' lot. Ericson <br />stated that he has paid taxes on both lots thinking they <br />were buildable lots. Ericson stated that the garage <br />could be moved, if needed. Ericson stated that when <br />the sewer went in, they put in two stubs. Ericson <br />stated that he only paid for one, because the City <br />didn't do their job when they put in the sewer and the <br />stub that is for the present house is way over by <br />neighbor's driveway. Cricson stated that at that <br />time, he told the City he would pay for it when the City <br />fixed it. <br />Mayor Butler stated that if the City approved this <br />subdivision with variances, there are 43 other <br />properties that would ask for the same consideration. <br />Councilmember Frahm moved, Councilmember Grabek <br />seconded, to request staff to draft a resolution of <br />denial based on the following findings made by the <br />Planning Commission: <br />
