PAGE 1.5 <br />#820 Fisk (cont) Grabek stated that the lot would look better with a <br />house on it because of the dumpy appearance of the lot. <br />Councilmember Grabek asked that the motion be read <br />again. <br />Mayor Butler moved, Councilmember Ada:ns"s,!rc;nded, to <br />request staff to draft a resolution of denial 'based upon <br />the following findings: <br />1. The property can be put to a reasonable allowed use, <br />park use or combination with adjacent property. <br />There is an outstanding offer to purchase the <br />property. <br />2. The proposes variance is contrary to the letter and <br />intent of the Orono Comprehensive Plan. <br />3. The dev-lopment and/or granting of the variance <br />would set an adverse pr;:!cedent in the City. <br />4. The applicant/pkirchaser should have had knowledge <br />of the zoning code requirements prior to the <br />purchase. Any hardship would seem to be self- <br />imposed. <br />S. There is only a 1/2 sewer unit charge against the <br />property indicating a question on the part of the <br />City at some time that the lot is substandard. <br />6. There is no lateral sewer assessment levied against <br />the property indicating its substandard status. <br />7. The property falls short of the zoning standards to <br />an extant too great to enable justifi(--ation of <br />granting the variances requested. <br />8. The property does not conform to the development <br />pattern of the neighborhood. <br />More discussion was held before the vote was taken on <br />the motion. <br />Councilmember Grabek stated that he didn't think that <br />the finding "that the property could be put to another <br />use" should not concern the Council. Grabek stated <br />that the purchase of the lot, the Council should not be <br />involved with or whether or not there is an offer or not. <br />Grabek stated that this should not be a precedent issue. <br />Mayor Butler stated that to grant this variance would <br />indeed establish a negative precedent policy within the <br />City. Butler sLat-ed that not just within this <br />neighborhood but within the entire City. <br />
