City of OR ONO <br />RESOLUTInN OF THE CITY COUNCIL <br />NU. <br />A RESOLUTION GRANTING A VARIANCE AND CONDITIONAL USE PERMIT <br />TO MUNICIPI-L ZONING CODE SECTIONS 10.03, SUBDIVISIONS 19, <br />20, AND 21 AND SECTION 10.55, SUBDIVISION 8 - FILE 4868 <br />WHEREAS, Leek ley's Inc. (hereafter "the applicant") is owner <br />of the property located at 2450 Sixth Avenue North within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Lot. 2, Block 1, willow Run (hereafter "property"), and <br />WHEREAS, the applicant has applied to the City of Orono for a <br />variance to Municipal Zoning Code Section 10.55, Subdivision 8 to <br />allow excavation of a wildlife pond within a designated wetlands, and <br />has applied for a conditional use permit per Section 10.03, <br />Subdivision 19, 20, and 21. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as zoning file 1868. <br />2. The property is located in the RR-lB Rural Residential <br />Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 17, 1984, and recommended approval of the <br />propo-ed variance and conditional use permit as amended <br />based upon the following findings: <br />a) The excavation for the pond will have no detrimental <br />effect on the surrounding property. <br />b) The improvement wi 11 enhance the aesthetic value of <br />the property. <br />c) The excavation will not impede the natural drainage <br />of the area. <br />
