City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING A VARIANCE TO <br />:CIPA1. ZONING CODE SECTION 10.24, SUBDIVISION 5(i. FILE 1858 <br />WHEREAS, Robert L. Howells (hereinafter "the i pf ,Acant" ) is <br />owner of the property located at 1448 Park Drive within `he City of <br />Crono (hereinafter "City"; and legally described as follows: <br />Saga Hill Park, in "Sara Hill Revised, Hennepin County, <br />Minnesota" (hereinafter "property"), and <br />WHEREAS, the applicant has applied to the City for a variance <br />to Municipal Zoning Code Section 10.24, Subdivision 5(B) to permit the <br />construction of a residence on a lot of 31,200 square feet in area <br />instead of the required 41,560 square feet, and toapprove a side street <br />setback of 17 feet where 35 feet is required and approve a f ront setback <br />of 26 feet from the ded.cated right-of-way where 35 feet. is required. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDING:. <br />1. This application was reviewed as zoning file #858. <br />2. The property is located in the LR-lB Single Family <br />Lakeshore Residential Zoning District. <br />3. The original platted area of "Saga Hill :'irk" was 0.80 <br />acre_ Dedication of County Road 19 right-of-way rt- 'aced <br />the area to 0.72 acres . The f urther dedication of roadway to <br />the City of Orono will reduce the lot area to approximately <br />0.6 acres. <br />4. The Orono Planning Commissio,.reviewed this application <br />on September 17, 1984, and recommended approval of the <br />proposed lot area variance based upon the follc-ing <br />findings: <br />a) The property is severe, restricted due to <br />surrounding road4ays. <br />b) No other land is available to be combined with <br />the property. <br />c) The location of thi ^ mature maple trees on the <br />property anO the locations of existing lot boundaries in <br />relat_-:ntothe existing traveled roads may require that <br />a setback r.nce is neeled f err. the east lc•t line. <br />d) The existing cabin is a :_fal non -conforming <br />structure and is subject to pertinent ord .�ances. <br />
