The building would be located approximately 575' <br />from Bayside Road. <br />B. The area located behind the new residence is a low area without driveway <br />access. The accessory building will be used for storage of equipment for <br />maintenance of the shared driveway. <br />C. The building would be located 70' from the north property line and a <br />minimum 30' from the side lot line. The building would be located as far <br />south as the existing well would allow. The well is located about 90' from <br />the property line. South of the well are mature trees that would be required <br />to be removed to make room for the building. The existing location would <br />take advantage of the building pad for the old house. No tree removal or <br />regrading would be required. <br />D. The existing building shall be removed prior to the City of Orono completing <br />a final inspection on the new building. <br />E. The height of the proposed building will be significantly lower than the <br />height of the existing house and will be screened from the road by existing <br />trees, therefore the visual intrusion of the accessory structure will be minimal. <br />5. The City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance will not adversely affect traffic conditions, light, air, nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />6. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 6
