Weckman has also <br />inspected the existing septic drainfield site on Lot 1. He finds <br />a failing system that drains into wetland on south side of <br />property. Weckman has asked that you delay all action on this <br />subdivision until septic testing has been provided confirming <br />suitable area for both principal and alternate on-site septic <br />site for Lot 1. Staff recommends that approval is conditioned on <br />a new septic system be installed prior to final plat approval. <br />Please review Exhibit F. In a letter from Lyle Oman in <br />February of this year. Brent Johnson was advised that a duplex <br />use of this rural property is illegal. Note the use was <br />confirmed by a newspaper ad advising of a studio apartment for <br />rent. Steve Weckman, upon completing a septic inspection for Lot <br />1, made an attempt to contact the current renter, Brent Johnson, <br />and found renters in the lower level. Staff has confirmed that <br />the house is being used for duplex use. Staff asks that we delay <br />all review of this proposed subdivision until the duplex <br />violation is removed. <br />Recommendation - <br />To table all action on the two lot subdivision application <br />of Mark Johnson for the property located at 4465 Bayside Road <br />pending resolve of the following: <br />1. Removal of duplex use violation. <br />2. Septic testing confirming suitable area for principal <br />and alternate on-site septic system serving existing <br />residence on Lot 1.
