MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, February 28, 2005 <br />7:00 o'clock p.m. <br />(11. #05-3084 JAMES AND PATRICIA OLSON, 4360 BAYSIDE ROAD, Continued) <br />Gaffron noted that staff found enough hardship to allow them to remain at 77', as opposed to the <br />increased 72'. <br />Olson reiterated that, due to the placement of the septic, drainage, slope of the land, and trees, they <br />could not come up with a better solution or design. <br />Mrs. Olson interjected that they had hoped to add some architectural interest to a 60's rambler. <br />W11ile he wished Council could give the applicant exactly what he wanted, Sansevere was hesitant <br />to set new precedent without hardship and not being consistent. <br />Attorney Barrett stated that he had not heard formal hardship which would warrant an additional <br />5'. <br />Since building a detached garage elsewhere on the site would cost them valuable pasture land for <br />their horses, Olson asked whether the Council would consider allowing them to continue across the <br />front line of their foundation rather than setting it back from the current straight line. <br />White stated that he was willing to extend the footprint of the foundation in keeping the look of the <br />house. He felt this would be consistent with the design of the home to allow the applicant an <br />additional 2'. <br />White moved, McMillan seconded, to deny the original variance request, but to adopt <br />RESOLUTION NO. 5288 with revisions that would permit a variance for the continuation of <br />the current front foundation line for construction of the proposed garage addition for 4360 <br />Bayside Road. VOTE: Ayes 5, Nays 0. <br />*12. #05-3087 ANDREW AND MARCIA FREESE, 2914 CASCO POINT ROAD - <br />VARIAN CE -RESOLUTION NO. 5289 <br />Murphy moved, Sansevere seconded, adopting RESOLUTION NO. 5289, a Resolution <br />granting a hardcover variance for the 75'-250' zone and an average lakesbore setback <br />variance for 2914 Casco Point Road. VOTE: Ayes 5, Nays 0. <br />*13. #05-3088 MICHAEL KURUVILLA, 850 WAYZATA BOULEVARD WEST- <br />CONDITIONAL USE PERMIT -RESOLUTION NO. 5290 <br />Murphy moved, Sansevere seconded, to adopt RESOLUTION NO. 5290, a Resolution <br />granting the conditional use permit and sign variances for Orono Montessori School located <br />at 850 Wayzata Boulevard West. VOTE: Ayes 5, Nays 0 <br />MAYOR/CITY COUNCIL REPORT <br />Murphy introduced Gabriel Jabbour who had just returned from a meeting with the Veterans Board <br />regarding the Big Island Vet Camp property and wished to make some comments. <br />PAGE 8 of 10
