<br />As you know, we represent Steve White. This letter follows our phone conversation last
<br />month regarding revislons to a Flowage and Conservation Easement Agreement proposed by
<br />your client, the City of Orono.
<br />I understand that Mr White has spoken with personnel at the City regarding concerns that the
<br />Flowage and ConseNation Fasement, ~s proposed, would prevent him or his assigns from
<br />obtaining a permit for construction of a dock or other uses wh1cri, but for the eas~ment1 couid
<br />be obtalned. Accordingly, I recommend adding the following new sub-paragraphs to page 2
<br />as follows:
<br />G. Nothing in this Flowage and Conservation Easement Agreement shall.
<br />be deemed to or construed to restrict the use of the Land beyond
<br />current zoning and/or land use restrictions.
<br />H. Nothing in this Flowage and Conservation Easement Agreement shall
<br />be deemed to or construed to restrict or limit the right of the Grantee or
<br />Gran1tee' s assigns to apply for a pennit for a dock.
<br />The nature and extent of any encumbrances against the Land should not affect the efficacy of
<br />the ~lowage and Conservation ~asernent. Accordingly, the last full paragraph relating to
<br />encumbrnncss shoutd be stricken.
