Burnet Title is working with Greg White and his <br />buyers on closing the sales of the lot line rearrangement. The Partial Release of Mortgage has been received and we <br />have scheduled the closings for both lots to take place this afternoon at 2:00. Initially the sales were structured as <br />Contract for Deeds. <br />The requirement of the lot line rearrangement is that the transferred portion shall not be considered a standalone <br />buiidable lot, and shall be legally combined with the revised property-added to the existing parcels. Dave at Hennepin <br />County has indicated they are not able to combine the transfer legal until the Contract for Deeds are paid in ful!. This <br />was my initial concern regarding the proposed sale transactions and the timing for each to be final, <br />The Steven and Patricia White purchase of the 7.06 acres will now be a cash purchase. The attached Warranty Deed will <br />be filed with the Resolution. The Todd and Lisa Sylvester purchase of the 4.61 acres will continue to be a Contract for <br />Deed purchase with the Balloon Date to be prior to the April 27,2016 deadline so that the Contract for Deed can be paid <br />in full and the Warranty Deed can be filed prior to the April 27, 2016 VOID/deadline. Because Burnet Title does not <br />have control over the Contract for Deed payoff, Burnet Title is asking for a letter from the City of Orono stating that if <br />the Contract for deed portion fa!is thru and the property is not deeded to Todd and Lisa Sylvester that the Steven and <br />Patricia White transfer with the recorded deed is still in effect on April 27, 2016. The current resolution does not <br />specifically state that the transactions can be transferred independently. The resolution allows for the lot lines to <br />be moved as shown. If one of the transactions does not happen it will not negate the approval for the <br />other 1.mless the resolution has expired. 60-days prior to expiration the property owner should request an <br />extension of the allowed filing time to be considered and granted by the City Council. <br />Can you please assist us with this request so that we can close this afternoon? <br />Thank you. <br />1
