A RESOLUTION ESTABLISHING A MORATORIUM ON THE � <br /> GR.ANTING OF VARIANCES FOR FILL AND EXCAVATION <br /> PERMITS OR OTHER AUTHORITY TO ALLO�n' FOR FILLING <br /> OR EXCAVATING IN ANY MANNER IN ANY OF THE <br /> MARSHE5 AND WETLANDS IN THE CITY OF ORONO <br /> WHEREAS, the City Council of Orono finds that the City <br /> is presently faced with the potential of numerous filling and <br /> excavating permit applications for filling and excavating in the <br /> marshes and wetlands of Orono, and <br /> � WHEREAS, it is necessary to adopt amendments to the <br /> zoning code in order to achieve the goals of providirig the City <br /> with satisfactory tools to guide the filling and excavating in <br /> marshes and wetlands and to enable property owners to develop new <br /> uses which are not adverse to marshes and wetlands, and <br /> WHEREAS, "the Council finds that such amending is a pro- • <br /> cess that cannot be accomplished until numerous detailed studies <br /> have been completed and hearings held, and . <br /> I WHEREAS, the Council determines that there is an urgency <br /> involved because of the need to control filling and excavating in <br /> marshes and wetlands during the interim period so that the bene� <br /> � fits of proper planning will not be lost, to prevent the destruc- <br /> tion of the marshes and wetlands, and to preserve the status quo <br /> pending adoption of these measures so that the City will not be <br /> impaired �.n its. ability to effectuate the purposes of goals of <br /> these planning efforts, and <br /> WHEREAS, the enactment of an amendment will undoubtedly <br /> modify existing regulations concerning filling and excavating, the <br /> granting of various filling and excavating permit applications <br /> during this interim period would �be detrimental to the effectua- <br /> tion of the comprehensive plan and contrary to the purposes of <br /> the Zoning Enabling Act, Minnesota Statutes, � 462 .351 et seq. <br /> The Council further finds that it would be unwise, improper and <br /> unjust to allow individual iilling and excavating to occur during <br /> this study period to avoid discrimination and unfair advantage to <br /> a few and to the detriment of the entire City, <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of � <br /> Orono adopts this resolution establishing a moratorium on the <br /> granting of variances for fill and excavation permits or other <br /> � auth�xity to allow for filling or excavating in any manner in any <br /> of the marshes and wetlands in the City of Orono.
